Assumption of Risk and Release from Liability for Savsani
1. Voluntary Participation. I acknowledge that I have voluntarily elected to participate in the subscription coordinated by or for Savsani. I further acknowledge and agree that practice is a voluntary recreational activity. Each practice I participate in with Savsani shall be subject to the terms of this Assumption of Risk and Release from Liability for Activities.
2. Physical Condition. I acknowledge that it is my sole responsibility to consult with my personal physician regarding any medical condition, impairment or disability that might prevent or limit my ability to engage in the practice. I further understand and agree that I am solely responsible for abiding by my personal physician’s recommendation as to any such medical restrictions on my engaging in the subscription.
3. Products. I hereby agree to release, defend, and hold harmless Savsani and its agents, employees and representatives from and against any claims, damages or liability arising from or related to any Savsani products.
4. Assumption of Risk. I am aware that there are risks and hazards associated with the subscription and voluntarily assume all rise of loss, damage or injury to person or property which may arise from or is related to my engaging in Savsani practices, whether such risk is known or unknown to me. I further understand and agree that I am not covered by workers compensation for any injury I incur which arises out of the practices.
5. Release. I hereby agree and understand that I, my assignees, heirs, distributees, guardians and legal representatives will not make a claim against, sue or attach the property of Savsani or its subsidiaries, officers, agents or employees for injury or damages resulting from the negligence or other acts, however caused, by any employee, agent or officer of Savsani as a result of my engaging in the practices. I hereby agree to release, defend, and hold harmless Savsani and its officers, agents and employees from all actions, claims or demands that I, my assignees, heirs, distributees, guardians and legal representatives now have or may hereafter have for injury or damages resulting from my engaging in the practices.
6. Recordings. I grant Savsani and its assigns, licensees, successors in interest, and legal representatives the irrevocable right to use my image and voice depicted in any photographs or video taken by Savsani, or its agents, employees, or representatives in connection with the practices (“Images”). I hereby waive any right to inspect or approve any Images, and I waive any right to royalties or other compensation arising from or related to the use of any Images. I hereby agree to release, defend, and hold harmless Savsani and its agents, employees and representatives from and against any claims, damages or liability arising from or related to the use of the Images. I agree to execute in the future any further documents that may be necessary to perfect Savsani’s ownership of all rights in the Images or other works containing the Images. I acknowledge that I shall not have any rights or interest in the Images whatsoever.
By purchasing or subscribing you are in agreement, assumptions of risk and release liability for Savsani.
